Terms and Conditions 

Please read through the terms and conditions on our website thoroughly before enrolling. When enrolling as a student of The Yoga Ground you agree to the terms and conditions as laid out on Shanti Wellness Yoga Studio (ShantiWellnessFL.com)  

GENERAL

  1. All purchases of services (classes, workshops, events) are non-refundable.

  2. Purchases of products are only refundable in new and unused condition up to 10 days after purchase.

  3. All students must have a unique online account associated with a unique email address. Friends and family members may not share the same email address.

  4. Because Shanti Wellness Yoga Studio rates are already much less expensive than all other studios in the area, no additional discounts will be given on class packages, intro offers, or unlimited packages.

  5. Every effort is made to hold class on time. The schedule is subject to change with different seasons and change of demand. Please check the online schedule for the most up-to-date schedule. Shanti Wellness is not liable to refund, transfer or offer compensation of any kind for classes that are late, changed or cancelled for any reason.

  6. Please arrive at least 5 minutes prior to class start time. Door will be closed at the start of class time and will not open again until class has ended. Please be considerate and plan accordingly (pls refrain from knocking, as that is disruptive to other yogis who arrived on time for class)

  7. Please take other into account when arriving, to reduce the amount of noise pollution in the space, and specially during class time. Avoid banging, uninstructed humming, and other sounds that can be disruptive during class time. 

  8. All “Class Pass” package holders must pre-register for class. No exceptions.

  9. Payment must be made upon booking, or if paying cash, payments must be made at the beginning of class. No students will be permitted to attend class, workshop, or event as unpaid unless payment has been completed. Unpaid classes or membership payments will be back-charged, and a late fees may apply.

  10. Although we have a wonderful community of friends and neighbors that attend our classes, and the space is setup to keep everyone safe and comfortable, Shanti Wellness is not responsible for the safekeeping of your personal belongings.

  11. You agree that you have been examined by a qualified medical practitioner within the past six months and have been found by such practitioner to be in good physical health and physically able to perform all yoga classes.

  12. It is the responsibility of the student to notify teachers of any previous injury, illness, or conditions that may impact their practice.

  13. Classes at Shanti Wellness may be physically strenuous and you voluntarily participate in them with full knowledge that there is risk of personal injury, property loss or death.

  14. You will follow all instructions given to you by Shanti Wellness teachers and you acknowledge that any failure to do so will be at your own risk and may cause injury.

  15. In attending classes at Shanti Wellness, you agree that neither you, your heirs, assigns or legal representatives will sue or make any other claims of any kind whatsoever against The Yoga Ground or its members for any personal injury, property damage/loss, or wrongful death, whether caused by negligence or otherwise.

  16. Shanti Wellness reserves the right to refuse entry.

  17. Prices may increase from time to time to reflect increases in cost and benefits.

  18. Terms, Conditions, and Fees are subject to change without prior notification.

  19. By booking into a class you automatically agree to the above terms & conditions.

  20. Online booking window for classes opens 10 days prior to the booking date, and closes 90 minutes before class start time. 

  21. Online booking is required for the following classes: Sunrise Yoga, Aerial Beginner and Advanced, and all Virtual Yoga classes. 

  22. Online cancellations for classes can be done up to 45min prior to class start time. If the cancellation window is missed, but a message via phone or email is sent to Shanti Wellness informing of the need to cancel prior to class start time, a cancellation will be completed for this request. This does not apply for messages received after class start time. 

  23. Refund for class booking cancellation completed within appropriate time is initiated immediately at the time that the cancellation is completed.  

  24. You agree that you have consulted your physician prior participating in a Shanti Wellness online fitness/wellness/health programs, and assume full responsibility for the results you may experience from your participation. Online programs are designed to provide wellness/fitness/nutrition tips and information, and are not meant to treat or replace any medical programs, nor should you assume that your results will be the same as the results that other Shanti Wellness members may experience. 

 

CLASS CANCELLATIONS & BOOKING ETIQUETTE

  1. If you do not show up for a class and do not inform Shanti Wellness of your plan changes, your charge for the class will stand, and no refund will be offered. If there is an exception to this rule, it will say so in the description of the class as well as at the time of purchase. If you missed the 45min prior to class start window, you can still each us via email or phone before class start time to let us know of the change. 

  2. Workshop and event cancellations: For local performers and presenters, must be requested 48 hours prior to the start time, and at least 72 for all out of town performers and presenters . If you do not attend or cancel within the corresponding 48 or 72 hours from start time, you will be fully charged for the workshop and will not be able to use the credit for a future workshop. Workshops, events and trainings are non-refundable with out notice.

  3. Credit Card fees will be deducted from refund total. 

  4. Credits will not be provided for enrollments canceled by student without a notifying Shanti Wellness of said cancellation.

  5. Please cancel if you are unable to attend a class or workshop  to make your space available to others.

 

Yoga Classes

  1. Gear to bring: mat, towel, and water bottle.  If you do not have a mat, we have a limited amount of yoga mats for rent at the small fee of $3. Water can be purchased or you can fill your own water bottle for free from our filtered dispenser.

  2. No shoes are allowed in the yoga studio space.

  3. No cell phones/tablets/smart watches are allowed in the yoga studio space. They must all be turned to Airplane mode.

  4. Please read "requirements, recommendations, registration" email that you will for the following classes: Aerial (beginner and advanced), Gentle, Yin, and Zen Infused.

  5. Arrived arrival time prior to class start time: 5 minutes for regular classes, 10 minutes for all aerial classes.

Class Pass Packages With Set # of Classes

  1. A client may have the amount of a class package/plan/membership that has yet to be upgraded to another package/plan/membership within the same account.

  2. 20 Class Packages will expire 100 days after day of purchase.

  3. 10 Class Packages will expire 60 days after day of purchase

  4. 5 Class Packages will expire 40 days after day of purchase.

  5. Class packages may not be shared between students. 

  6. All Class Pass Package holder must pre-register for class. 

 

Unlimited Packages

  1. Unlimited memberships may not be shared.

  2. Unlimited memberships will continue to be charged until cancelled via phone or email to Shanti Wellness.

  3. Unlimited years expire 364 days after day of activation.

  4. Unlimited packages that have yet to be used may not have credit back.

 

Introductory Offers

  1. Our new student specials are only available to brand new students, no matter how long it has been since you have been to a class at Shanti Wellness.

  2. Only one intro promotion per student is permitted. If you choose the 30 for $45, you may not purchase the 3 for $30 sampler, or any other intro offer at the time.

  3. All promotions are non-transferable and non-returnable and cannot be shared.

  4. Clients found to be buying the Intro offer more than once will be charged additional class costs they may have incurred, and the additional intro offer will be cancelled.

 

Monthly Auto-Renew Memberships

  1. Monthly auto-renews cannot be shared.

  2. You will be charged the same amount, on the same day of each month for your auto-renew.

  3. Membership fees will automatically be charged to your credit card.

  4. You can update or change your credit card in your online account or in studio.

  5. Auto-renews can be frozen up to 30 days per calendar year (January-December) unless you have a note from a doctor. Your subsequent monthly auto-payment will shift forward by a commensurate number of calendar days. Pause requests must be in writing by emailing ShantiWellnessFL@gmail.com. Please allow 48 hours to process request.

  6. Your auto-renew can be cancelled at any time after your contract has been completed (3 or 6 months) in writing by emailing ShantiWellnessFL@gmail.com. If you cancel, you may lose your existing rate. Please allow 48 hours to receive and process your cancelation request.

  7. If your monthly auto-payment fails for any reason, then your membership may be cancelled and/or you may be assessed a fee.

  8. No Commitment auto-pay memberships can be cancelled at the end of the term with a 15 day notice via email.

  9. It is your responsibility to ensure there are sufficient funds available to cover the monthly auto-debit. Should a payment be declined for any reason, Shanti Wellness reserves the right to process payment at any time to settle any debt owed.

  10. Shanti Wellness is not responsible for additional bank fees that you may incur from your bank. Bank fees are under the terms and conditions of contractual agreements that lie between you and your bank.

  11. If auto-debit payments fail for 2 payments or more, Shanti Wellness may cancel the membership. You will be ineligible to sign-up for an auto-renew membership after 15 days.

  12. All account debts must be settled before cancellation of membership can be finalized, this includes all late cancellation and no show fees incurred.

  13. We reserve the right to cancel memberships. 

 

GIFT CARDS 

  1. Gift cards can be redeemed for classes, workshops, programs, account credit, and/or retail purchases.

  2. Gift cards can be purchased and sent electronically through our online store or in-studio.

  3. Gift cards are non refundable and not redeemable for cash.

Who do we contact?

Shanti Wellness and ShantiWellnessFL.com will only contact individuals who specifically give us consent. Consent may be given by contacting us through our website, creating an account on our website/booking platform, or by purchasing one of our products or services.

What information do we collect and where is it stored?

Personal Data:

  1. Your first name, last name, phone number (optional), and e-mail address as provided by you contacting us through ShantiWellnessFL.com

    1.  This information is stored in:

      • Wix: If you provided us with your first name, last name, e-mail address, and phone number by filling out the contact us form on our website, your information is collected and stored on Wix. 

      • Your information can only be accessed by Lele Niper.

  1. Your full name, postal address, cell phone, email address, emergency contact name and phone number, and date of birth, provided by you when registering to schedule and purchase classes at ShantiWellnessFL.com website platforms.

    1. This information is stored on Wix Booking. It is used as a way to contact you about account issues and promotions, and as a means of providing safe service to you. Click here for Wix privacy policy.

    2. Your Information can be accessed by Lele Niper and the instructor of the class you booked at Shanti Wellness.

    3. If you would like any of your information deleted, please access your profile and make changes desired.

    4. If you subscribe for the monthly auto-renew you will be asked to give consent to store your credit card information for future billing. Should you ever cancel your auto-renew, you can email ShantiWellnessFL@gmail.com  to delete your profile.

All such information is strictly protected and used only for delivering the content and products the user has signed up for or purchased. This information is never used for other purposes and is never shared with 3rd parties for their own use. This data can be deleted at the request of the consumer as long as it is in compliance with the signed contract.

Processors/Vendors Used Who Collect Information:

Lele Niper and ShantiWellnessFL.com, uses some processors/vendors to run as a business. These include:

1.  Wix Booking to create account, schedule classes, make purchased, and collect automatic payments.

 ShantiWellnessFL.com does not share your information with these processors/vendors. Information will only be provided to these processors by YOU in order to sign-up at these sites. The information collected by these processors is stored by them. Click the links to be taken to the privacy policies of the associated processors.

Existence of Individual rights:

As a consumer of products and services offered by Lele Niper and ShantiWellnessFL.com, you have the right of:

  • Access to your personal data – to know what data is stored where.

  • To correct personal data where it is incorrect or incomplete

  • To delete personal data as long as it is not necessary to uphold your signed contract

  • Restrict/suspend processing of personal data in compliance with your signed contract

  • Complain to a supervisory authority

  • Withdraw consent at any time unless doing so goes against what was agreed upon in your signed contract

  • Object to processing in compliance with your signed contract

Anonymous Usage History (non-Personal Data)

This information is strictly limited to the history of activities that you engage in while on our site. It does NOT include any personally identifiable information (PII).

The purpose of this information is to improve your experience.

For example, by submitting your feedback, you help Shanti Wellness improve the quality of service and offerings, but it is not going to be shared with other parties.

There is a small subset of this history that we use with 3rd parties, such as Wix, for the purpose of measuring and improving the efficacy of advertising campaigns.

Any third parties you may choose to use in the process of connecting with our system, such as Google, may aggregate such information across many websites. This allows them to identify users who are more likely to be interested in specific offerings. Please see the privacy policies of any third parties you may use in this process for more information.

What are cookies and how do we use them?

Cookies: Like many other commercial sites, our site utilizes standard technologies called "cookies" and clear GIFs to collect information about how our Site is used. A cookie is a small data text file, which a website stores on your computer's hard drive (if your web browser permits) that can later be retrieved to identify you to us. Cookies were designed to help a website recognize a user's browser as a previous visitor and thus save and remember any preferences that may have been set while the user was browsing the site.
